Why this Bolton Legal Situation Stands Apart Substantially from Other Trump Opponents

Former President Donald Trump has consistently shown his wish to see critics investigated, exerting influence on the Justice Department to charge former FBI Director James Comey and New York Attorney General Letitia James.

"We cannot postpone any longer, it's killing our reputation and trustworthiness," the leader wrote recently in a social media post.

"They impeached twice, and charged me (5 times!)" he declared, mentioning the multiple legal proceedings he encountered after departing the White House in 2021 and James's lawsuit.

Each have subsequently been indicted, in situations that many experts have stated appear to be driven by politics and challenging to succeed in court.

But the latest charges against a Trump critic, former security advisor John Bolton, stand apart, legal experts and ex-prosecutors assert.

"I would say, comparing Bolton's charges to Comey's is like comparing apples to oranges," said Mark Lesko, a ex federal prosecutor for the Eastern District of New York.

The Details of Bolton's Legal Situation

Bolton has been formally charged on national allegations related to the supposed improper handling of classified information. After departing the White House in 2019, he has become a vocal Trump critic, going so far as to call him "remarkably ignorant" and unsuitable for the presidency in his book.

Specialists say that while there may be political reasons to target Bolton, the methods used to secure an charge and the proof compiled against him suggest a potentially more substantial legal argument than the Justice Department presented against James.

"These actions that's being claimed is simultaneously more serious and appears to have taken place over a significant duration," commented Carissa Byrne Hessick, a academic at the University of North Carolina School of Law.

Throughout his time as Trump's national security adviser, and following his 2019 White House departure, authorities alleged that Bolton placed the country at danger by improperly keeping and transmitting classified information to family members using unprotected methods, including AOL. Several of the documents were labeled top secret.

The charge states that at a certain time a unauthorized user accessed to Bolton's account where files were kept and transmitted an apparent threat to cause "the biggest scandal since Hillary [Clinton]'s emails were released".

Bolton entered a not guilty plea during a court appearance on recently to 18 distinct counts of mishandling sensitive materials.

However, he continued, "should the DOJ is capable to prove the facts alleged and demonstrate the information is properly designated, his conduct may very well have broken the law".

Prosecuting such a senior figure for mishandling classified documents is "rare" but not without precedent, said Carrie Cordero, a senior fellow at the Center for a New American Security.

"Situations that involve classified information pose difficulties to try, but they can and are filed against equally junior and high-level personnel, from time to time," she said.

Parallels to Investigations into Former President and President

Trump likewise encountered allegations of improperly keeping classified documents at his Mar-a-Lago property in Florida and hindering their recovery, but that case was ultimately dismissed by a court official and negated by his re-election as leader.

A special counsel also found that ex-President Joe Biden wrongfully stored sensitive materials from his time as second-in-command, but did not criminally charge him.

Bolton's case bears similarities to Biden's sensitive materials matters, said Mr Lesko, who previously held a senior national security position at the DOJ.

Rigorous protocols regulate the handling of sensitive materials. To win a conviction, the government must demonstrate that Bolton was aware the material he was sending was classified, and he had to intentionally transfer it to someone without authorization to obtain it.

"Because of the sensitive nature of the information at question in this matter, we lack a lot of particulars about the reasons the government believes elements like the diary entries and the other information he shared by email, and the reason there were classified," said Mr Jaffer.

A Increasingly Traditional Prosecution

The process by which the DOJ brought this case will be closely examined, after Trump publicly expressed his wish to see his political opponents prosecuted and some of those indictments materialized.

But Mr Lesko said in Bolton's case, authorities appear to have followed protocol.

"This Bolton prosecution and ultimately the indictment appeared to have observed the standard process including the regulations and standards within the Department of Justice," he stated.

In contrast to Comey's brief, two-page charge, Bolton's was a more "traditional" document that "explicitly sets forth the details concerning the facts and circumstances in this instance," Mr Lesko commented.

"It appears reasonably aligned with a long line of cases... where government officials mishandled and transmitted sensitive information."
